May 14, 2019: Murder Charge Filed in Alleged Pomona DUI Crash That Killed Six-Year-Old Boy

A 19-year-old has been charged with killing a 6-year-old boy in a wrong-way DUI crash in Pomona earlier this month, the Los Angeles County District Attorney’s Office announced.

Franky Antonio Provencio (dob 4/27/00) faces one count each of murder and driving under the influence of alcohol and a drug causing injury within 10 years of other DUI offense.

Deputy District Attorney Elizabeth Padilla of the DUI Training and Prosecution Section said Provencio also faces one misdemeanor count of possessing methamphetamine and allegations of inflicting great bodily injury as well as having been previously convicted of driving under the influence of a drug in January.

Provencio pleaded not guilty to the charges yesterday and is scheduled to return on June 5 in Department N of the Los Angeles County Superior Court, Pomona Branch. Case KA120979 was filed for warrant on May 9.

The defendant was driving an SUV northbound on White Avenue near McKinley Avenue when he drifted onto the southbound lanes and crashed into a pickup truck, the prosecutor said. The driver of the truck was seriously injured and his son, Julian, died as a result of his injuries, the prosecutor added.

If convicted as charged, Provencio faces a possible maximum sentence of 22 years to life in state prison. Bail is set at $2.13 million.

The case remains under investigation by the Pomona Police Department.
